General Terms and Conditions
1. All deliveries and services provided by Cleaning-tools Internethandel based on online orders via the Internet or other online services are subject to these Terms and Conditions. Deviating and/or supplementary agreements require the express consent of Cleaning-tools Internethandel and must be in writing; this also applies to any waiver of the written form requirement.
2. Cleaning-tools Internet trading will, wherever possible, adhere to agreed or specified delivery times. If these are exceeded by more than six weeks, the customer has the right to set a grace period, stating that they will refuse acceptance of the purchased item after the deadline has expired. This grace period must be at least one month. If an agreement on a new delivery date cannot be reached, the customer may withdraw from the contract by written declaration after the grace period has expired. Should the buyer demand compensation for non-performance in the event of delay or impossibility, this compensation is limited to a maximum of 5% of the purchase price in the case of slight negligence and only includes compensation for direct damages, i.e., in particular, compensation for lost profits or other indirect damages. Further claims by the buyer – in particular for delivery – are excluded.
3. The risk is transferred to the customer as soon as the goods are handed over to them by the carrier. Complaints regarding transport damage must be reported directly to the carrier by the customer within the specified deadlines. For shipments by the customer to Cleaning-tools Internethandel, the customer bears all risks, particularly the transport risk, until the goods arrive at Cleaning-tools Internethandel.
4. Initial deliveries are generally only made by cash on delivery, advance payment, or direct debit.
Invoices from Cleaning-tools Internethandel are due within 14 days and payable without any deductions. From the 30th day after the invoice date, Cleaning-tools Internethandel is entitled to charge default interest at a rate of 3% above the current discount rate of the Deutsche Bundesbank, unless Cleaning-tools Internethandel can prove higher default interest or the buyer can prove a lower charge to Cleaning-tools Internethandel, without the need for prior reminders. Checks are only accepted as payment. Any expenses are borne by the customer. Set-off is only permitted with undisputed or legally binding claims. The customer may only assert a right of retention if it is based on the same contractual relationship. Telescopic poles and water flow poles with segments over 2m long are custom-made and are excluded from return or exchange.
5. Complaints regarding scope of delivery, material defects, incorrect deliveries, and quantity discrepancies, insofar as these can be determined through reasonable inspection, must be made in writing immediately, but no later than one week after receipt of the goods. The warranty period for Cleaning-tools Internethandel is six months from receipt of the goods. In the case of justified complaints, Cleaning-tools Internethandel will deliver any missing items and, subject to exclusion, will, at its discretion, exchange the goods, take them back, or grant the buyer a price reduction. If, in the case of an exchange of goods, the second replacement delivery is also defective, the buyer is entitled to a replacement or a reduction in price. The warranty for defects in devices is limited to repair.
Defective deliveries must be returned at the buyer's expense before any refund can be made.
Shipping costs for items for which claims are made without justification will not be refunded.
6. For orders with a net value of less than €80, we charge a minimum order surcharge of €10. For orders with a net value of €200 or more, shipping is free.
7. The purchased item remains the property of Cleaning-tools Internethandel until all claims arising from the contract have been settled. The retention of title also remains in effect for all claims that Cleaning-tools Internethandel subsequently acquires against the buyer in connection with the purchased item, e.g., due to repairs or other services. During the term of the retention of title, the buyer is entitled to possession and contractual use of the purchased item, as long as they fulfill their obligations under the retention of title and their obligations arising from the business relationship in a timely manner. The customer is obligated to provide Cleaning-tools Internethandel with all information necessary to assert their rights under the agreed retention of title.
8. Cleaning-tools Internethandel is entitled to collect, store, and process the customer's personal data required within the scope of the business relationship. However, we assure you that we will not share your data with third parties.
9. The invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision that most closely approximates the economic effect of the invalid provision.
10. Disputes arising from a contractual relationship and concerning its existence shall be subject to the jurisdiction of the court of the place where the disputed obligation is to be fulfilled (Section 29 of the Code of Civil Procedure).
